1.Scope of Application
These general rental terms and conditions apply to all reservations and agreements related to Villa Buena Vida Curaçao (hereinafter referred to as the “villa”). For the purposes of these terms, “tenant” refers to the person entering into a rental agreement with the owners regarding the villa. Deviations from these general conditions are only valid if agreed upon in writing beforehand.
2. Receipt of Keys and Gate Access Cards
Keys and gate access cards are handed over at the villa by the property manager. The tenant is never permitted to duplicate keys or gate access cards for any reason. Any violation will incur a penalty of €500, in addition to any actual costs.
The keys and access cards remain the property of the villa owners and must be returned to the property manager at the end of the rental period. In case of loss, theft, or other disappearance of keys or access cards, the tenant shall pay €100 per key/card.
If the tenant or other users lock themselves out of the villa, a fee of €50 will be charged, which will be deducted from the security deposit. The property manager may request identification from the tenant before handing over a replacement key.
3. House Rules
The villa is intended exclusively as a private residence. It is located in a gated community, not a holiday resort.
No nuisance is permitted for neighbours, nor nudity/topless sunbathing, parties, or gatherings exceeding the number of booked guests, unless prior written consent is obtained from the villa owners or property manager.
Quiet hours are 23:00 to 07:00. For questions, consult the property manager.
Check-in is after 16:00, and the villa must be vacated by 10:00 on departure day.
Property Care Curaçao manages the villa. The manager will welcome the tenant, provide an orientation, and answer any questions regarding the villa. A folder is available in the villa with important information and house rules of both the villa and Marbella Estate. Tenants and other users must behave responsibly during their stay.
The use of illegal drugs in or around the villa is strictly prohibited. The villa is non-smoking. Smoking is allowed only on terraces or balconies unless otherwise indicated. Smoking indoors incurs additional cleaning fees. No open flames (BBQs, oil lamps, etc.) are allowed in the palapa. Fireworks are prohibited in and around the villa and Marbella Estate; all resulting damages are the tenant’s responsibility. Pets are not allowed. Exceeding the maximum number of persons booked or permitted without the owners’ prior written consent may lead to early termination of the rental agreement without refund.
Moving furniture, beds, or electronic equipment, or taking interior items outside the villa is not allowed, except for tableware, glasses, and cutlery.
4. Use of Villa Pools
Private Villa Pool
Glassware is prohibited in and around the villa pool. Plastic cups are provided.
Shared Marbella Estate Pool
Open 07:00 – 21:00.
Glass is prohibited in and around the pool.
Showering before entering the pool is mandatory.
Parties at the pool require prior written approval from the estate management. After approval, parties are only allowed for owners, residents, and their guests. Dispose of trash in designated containers after use. Pets are prohibited in and around the pool area to prevent contamination. Proper swimwear is required.
Maintain quiet between 21:00 and 07:00.
5. Liability, Complaints, and Damage
The tenant and users are fully and jointly liable for all damage caused to the villa, its inventory, and associated property, unless they can demonstrate the damage was not their fault. Any observed damage or defects must be reported immediately to the property manager. The villa owners accept no liability for:
- Theft, loss, or damage of items or persons during the stay;
- Construction activities in the vicinity of the villa;
- Electricity outages, technical malfunctions, internet or TV interruptions.
Costs of normal maintenance and defect repairs are the responsibility of the villa owners. Tenants must inform the manager immediately if defects occur and follow instructions as much as possible.
6. Departure and Final Cleaning
Any costs arising from late vacating of the villa will be charged to the tenant.
Items left behind after departure will be stored for a reasonable period without liability.
At the end of the rental period, the villa must be left tidy: kitchen appliances and BBQ cleaned, trash disposed, safe emptied, and doors left open. Final cleaning costs are the tenant’s responsibility and included in the invoice at booking.
7. Governing Law
Dutch law applies to all conditions and provisions of the rental agreement and house rules, as well as any disputes arising therefrom.
